Terms of services

By commissioning me in any kind of way, you are agreeing to the terms of service below.Any statement can be bound to change if discussed with me, the artist, prior to the commission.Breaking my TOS will lead to serious action by the artist.VGen is the platform use by the artist for art commissions. Clients don't need a VGen account to send a request.

[ I.] GENERAL TERMS

Please write in a clear and nicely as well as providing neat references and not just paragraphs of text.Any ill behaviour will not be tolerated, and your commission can be cancelled if it occurs and failure to follow the rules provided I have the right to decline your commission.I’m available for communication on my free time for any questions concerning commissions or my art in general ♡I don’t usually work from 9am until 1-5pm due to my part time job.

*Weekend’s or Canada holidays are considered as my days off

[ II.] PAYMENTS

The complexity of the design doesn't change the prices.All commissions need to be paid full upfront. The split payment (by milestone) is only available for the waiting list.The clients in the waiting list will need to pay the first half upfront and the other half of the payment 1 day before or same day of the commission start.*exceptionally, the NDA or commercial fees can be part of the split payment request (need to be pay before delivery date).The spot in the list is permanent as soon the payment is received.

[ III.] PROCESS

WAITING LIST
Due to high volume demand, waiting list slots won't be "first come, first served" and will be under a selection.The waiting list is open after all OPEN slots are taken. The client will have to pay 50% upfront deposit to be part of the waiting list and the other 50% will need to be pay 1 day before or on the start date of the request.By reading and accepting this, the client agrees to wait for at least 1 week to 2 months before starting their project.2-3 slots are usually available for the waiting list (monthly). After all slots are filled, it will be close until I re-open again.I will be informing via message on X (Twitter) or VGen the day I start the request.GENERAL INFORMATION
All services in VGen are not "first come, first served" and anyone who aren't selected will be notify, after selection.Keep in mind, you can always apply again for the next batch. Due to high volume demand, I can't pick every single ones due to limited slots available.
_Any information concerning the commissions progress are in the Trello shared in my VGen “Work Queue”.Any modifications or events out of my control will be notified to the client and be published on Trello and X.Usage of my artwork option:
If you unsure what you category your use of my artwork fall under, feel free to put it under "other" option when requesting or message me.

Fees for my services :

I start on the request as establish in the “Estimated start” date and work in progress notification will be given to the commissioner.Discussions are open during the process!CHANGEMENTS
Changements for refular illustrations :
You can make up to 4 big changes during the sketch process and up 2 minor changes during the lineart + color base process only.Extra changes will cost 25$ USD each item of the drawing during rendering or after the finished artwork, no matter the size of it.
(ex. skirt + jewelry = 50$ USD)If you consider asking for more changes during the sketch phase, it will cost 13$ USD each time.
(ex. hair style + eye color = 26$ USD)Changes for Skeb sketch :
only 2 changes can be made. It will cost 10$ USD each item if more than 2 changes.Changes for VTuber model's :
Major changements aren’t meant to be apply for VTuber model’s since I mostly follow with my own interpretation the reference given by the client.Small changes are allowed during the whole process if the proportion or color need to be corrected or if there’s others things add/forgotten (need to be discussed with the artist).Riggers and clients are free to message me after delivery concerning the file (for modifications) since each rigger have their own need and style, and I’m 100% willing to help it to ease their workChangement can be also requested if the design isn’t suitable for Twitch / YouTube TOS.The option "add-ons and fees" is now available for previous or current clients who want to add other things on their model.ETA COMMISSIONS POLICY
*Notes: the Trello is a more accurate way on the timing and delivering of the commissions, base on my terms and services established.It is accessible to have the Trello schedule via my bio.The official deadline agreement for any commissions to be completed is within the maximum of 3 months. (this is base of VGen policy)

When payment is done and the start date set in the proposal arrive for your request, the 3 months agreement process start.Ordering more than 1 artwork or adding multiple add-ons will make the delivery date vary.

[ IV.] VTUBER MODEL

VTuber models come with commercial use in the base price. Some rules still need to be followed.I retain all copyright to my art.
Any artworks can be posted publicly (unless discussed in advance).The commissioner may repost and use the commissioned piece,
but credit must be given.

Selling the model: Selling the model: client / owner(s) cannot sell the model higher price and any next owner(s) need to follow same rules. Communication to the artist is required before selling it.Giveaways: client / owner(s) need to give communicate in advance for it and give proper credit of the artist when making the giveaway. Any next owner(s) have to follow the same rules.

Changements for VTuber model's:
Riggers and clients are free to message me after delivery concerning the file (for modifications) since each rigger have their own need and style, and I’m 100% willing to help it to ease their workChangements also apply during sketch phase (up to 5 changes) and during each part of the rendering phase (only the color changes acceptable during rendering).If the design isn’t suitable for Twitch / YouTube TOS after being delivered, the client is allowed to request a quick change.The option "add-ons and fees" is now available for previous or current clients who want to add other things on their model. All informations can be found via VGen for this option.Request for VTuber models:
Any requests can be made and send through VGen platform.Due to high volume demand, I'll be doing a selection (this is NOT a first come first served).People who aren't selected will be receiving a declined message after the selections are done.Keep in mind, you can always re-apply for the next commission opening.Everything will be announced via Trello and X when selection is made

[V.] SHOP SECTION

Any items or / and adoptable in the shop section will need to follow the same rules as any other art services I'm offering.(all rules in the section [V.] copyright / usage policy also apply )

[VI.] COPYRIGHT/USAGE

[VII.] CANCEL/REFUND

I have the right to cancel or refund the money for your commission at any time.You have no right to demand a refund from the artist under any circumstances after the first progress of the request has been started (sketch process).If money has not been sent yet, the commissioner has the right to cancel the commission.Any statement can be bound to change if discussed with me, the artist, prior to the commission.

[VIII.] COMMUNICATION

The artist and the client have the responsibility to have a communication throughout the process of the commission.I give the chance to the client to reply to my commissions updates for at least 1 week.All communication/notices will be made via the 2 methods: email and VGen to make sure the client receive properly the message. (since some platform doesn't notify the client)If the client doesn't answer after 1 week (for a feedback), I will need to delay the commission and change the delivery date.If the delay situation happens, the client will need to wait until I found a new spot into the schedule for a new update on the commission.
